Nature of Proceedings: Demurrer
For the reasons set forth herein, the demurrer of defendants Zack Vico and Elena Reyes is overruled. Defendants shall file and serve their answer to the complaint on or before March 12, 2013.
In this unlawful detainer action following foreclosure, defendants demur to the complaint.
Defendants Zack Vico and Elena Reyes are the former owners of real property located at 6091 Craigmont Drive, Goleta, California (the “Property”). (Complaint, ¶¶ 1, 5.)
The Property was sold to plaintiff Bank of America, N.A., successor by merger to BAC Home Loans Servicing, LP fka Countrywide Home Loans Servicing LP by the trustee under a deed of trust on January 5, 2012. (Complaint, ¶¶ 6, 7 & exhibit A.) The trustee’s deed following sale was recorded in the real estate records of Santa Barbara County on January 19, 2012. (Complaint, ¶ 7 & exhibit A.)
Plaintiff served defendants with notices to quit on February 8, 2012. (Complaint, ¶ 9 ........
