Nature of Proceedings: (2) Motions to Quash
For the reasons set forth herein, the motions of defendants Gorge Geare and Edward Roe to quash service of summons and complaint are denied. These defendants shall file and serve their respective answers to the complaint on or before January 29, 2013.
These are two motions to quash service of summons in a post-foreclosure unlawful detainer action.As alleged in the complaint, plaintiff Deutsche Bank National Trust Company (“Bank”) became the owner of real property located at 1040 Ocean Vista Lane, Santa Barbara, California, (the “Premises”) by a trustee’s deed upon sale following a foreclosure sale of the property on June 22, 2012. (Complaint, ¶ 4 & exhibit A.) The trustee’s deed was recorded in the real estate records of Santa Barbara County on June 28, 2012. (Complaint, ¶ 5 & exhibit A.)
The former owners of the Premises were Scott Williams and Brenda J. Williams, who are not parties to this action. (Complaint, ¶ 4.)
