Motion of Plaintiffs Jeff Hendrickson and Roxanne Renner to Tax Costs
Ruling:
For the reasons set forth herein, the motion of plaintiffs Jeff Hendrickson and Roxanne Renner dba Santa Rita Flower Farm to tax costs is denied. The Court fixes costs awarded against plaintiffs and in favor of defendants in the amount of $3,480.00.
Background:
This action was brought under the Cartwright Act asserting claims that plaintiffs were improperly excluded from farmers markets.
On July 1, 2013, one day before an opposition was due to defendants’ demurrer to plaintiffs’ second amended complaint, attorney for defendants, Timothy J. Trager, received an email from counsel for plaintiffs, Matt Da Vega. The email conveyed a settlement offer from the plaintiffs by which plaintiffs would agree to dismiss the action in exchange for an agreement that plaintiffs would have access to certain markets.
