Motion of Defendant to Compel Arbitration
Ruling:
For the reasons set forth herein, the Court finds that defendant Fighting Back Santa Maria Valley has failed in its burden to prove that an agreement to arbitrate exists with plaintiff Teresa Menchaca and therefore defendant’s motion to compel arbitration is denied.
This case apparently was filed in June 2011 and the Court notes that case management conferences have been held and presumably no action was taken in setting trial dates; the Court will address how the parties want to go forward in light of this ruling.
