Nature of Proceedings: Demurrer
This is a consolidated action arising out of the November 2008 Santa Barbara fire known as the “Tea Fire.” In the first case, plaintiff Department of Forestry and Fire Prevention (“DFFP”) has sued to recover fire suppression costs from defendants Joshua Grant Decker-Trinidad, Casey Lamonte, Stephen Reid, Lauren Vasquez, Mohammed Alessam, Hashim Hassan, Natalie Maese, Hope Dunlap, Fahed Al-Fadhel, and Carver McLellan. DFFP alleges that defendants negligently and in violation of the law started a fire and allowed it to escape onto public and private property. In the second case, plaintiffs Lance and Carla Hoffman (“Hoffmans”), who were severely burned in the fire as they tried to flee their leased residence, have sued the same defendants for negligence, gross negligence, and negligence per se. The Hoffmans have also sued the owner of the property where the fire originated, defendant Mary K. Robinson, in separate causes of action.
