Motion for Leave to File First Amended Complaint
Ruling:
The court grants the motion of plaintiffs Megan Amsler and Kyleen Dawson for leave to file a first amended complaint (FAC). The FAC will be deemed served as of October 18, 2011. Currently, the FAC only exists in the court’s file as an exhibit to a motion. Plaintiffs shall separately file an original FAC with the court no later than October 21, 2011.

This is an action for professional negligence. Plaintiffs Megan Amsler and Kyleen Dawson allege: They hired defendant law firm Fell, Marking, Montgomery, Granet & Raney, LLP, to provide due diligence and assist them in the sale of the business – Qualified Exchange Services (QES), a company specializing in 1031 tax deferred exchanges. After the sale of the business, the purchaser allegedly misappropriated customers’ funds and plaintiffs were sued by customers for $10,000,000, incurring costs in defending and settling these
