RULINGS

BACKGROUND

Judgment was entered in favor of Wallace in the amount of $290,000 on September 24, 2012. The Statement of Decision issued by the trial court reflected that, of that amount, $3,000 was awarded to plaintiff for defendant’s violation of Labor Code section 1194, along with an award of statutory attorneys’ fees in the amount of $2000. The Court pointed out that “the issue was very nearly de minimis non curat lex” (Latin, meaning “the law does not concern itself with trifles”). [Statement of Decision @ page 2, lines 11-12.]

Defendant Springall filed a notice of appeal from the judgment on September 27, 201........
