Nature of Proceedings: Hearing: Final Approval; Attorney Fees Background: This is a class action filed by plaintiff Elizabeth Flanagan, individually and on behalf of those similarly situated, against defendant Wells Fargo Bank, N.A. (“WFB”). The action arises out of WFB’s repeated debit charges on Flanagan’s business checking account for WFB’s Business Checking Debit Card Rewards Program in which Flanagan never enrolled and for which she never authorized a charge.
Flanagan’s first amended complaint set forth six causes of action: (1) unfair business practices, (2) breach of contract and breach of the covenant of good faith and fair dealing, (3) unjust enrichment, (4) conversion, (5) elder abuse, and (6) Consumer Legal Remedies Act. On September 21, 2011, the court granted WFB’s motion for summary adjudication as to the fourth cause of action for conversion.
