The court will deny Respondent/ Defendant’s Motion to Compel Compliance with Subpoena for Production of Business Records.
The court will grant Claimant/Plaintiff’s Motion to Quash or Modify Subpoena for Production of Business Records; the subpoena is quashed in its entirety. Sanctions will be awarded against defendant Progressive Insurance Company in the amount of $3,340.00 or according to proof to be paid to counsel for plaintiff within ten days.
Background. Plaintiff Michelle Ducket was involved in an automobile accident with a third party on January 28, 2008. Plaintiff settled her personal injury case with the third party and filed an underinsured motorist claim with her insurer, defendant Progressive Insurance Company. On April 5, 2010, this Court granted plaintiff’s motion to compel arbitration of her claim.
