The facts of the litigation, as they pertain to plaintiff and Easy lift, are that plaintiff, diagnosed with dementia in 2004, spent the day of the incident in the custody and care of the Friendship Center. Around 4:00 p.m., Easy Lift employee Bruce McLeod arrived at the center to collect 3 passengers in the Easy Lift bus, including plaintiff. Under Friendship Center policy, McLeod’s arrival and the names of the passengers he was picking up were announced by loudspeaker. Friendship’s policy requires that its staff bring to the lobby participants who will travel home with Easy Lift. They are not permitted to leave the participants until they are in the custody and control of the Easy Lift driver.
