Defendant Pierre Perrot’s motion to quash service of summons is DENIED.
Background
This is an action for breach of contract. Plaintiff Elise Sharon hired Defendant Pierre Perrot and his business Defendant Pierre Z Car Center, Inc., to perform restoration work on her vehicle, which she alleges was unsatisfactory. The complaint was filed July 03, 2007, and proofs of service regarding the summons and complaint were filed August 06, 2007. Defaults were entered December 14, 2007, and January 29, 2008. Judgment was entered April 11, 2008.
On September 16, 2016, Defendant moved to vacate the judgment. The Court granted the motion to vacate on October 11, 2016, on the grounds Defendant’s due process rights had been violated, because the complaint failed to provide Defendant adequate notice of the damages sought by Plaintiff. The Court refused, however, to set aside the default.
