The motion is denied without prejudice.

Plaintiffs seek to exclude evidence that plaintiff Patricia Yasui's history of smoking led to a slower recovery from the hip fracture and to a shorter life expectancy. Plaintiffs also seek to exclude the evidence on the issue of mitigation of damages. Plaintiffs contend the evidence is irrelevant and unduly prejudicial. (Ev. Code §§350 and 352)

Plaintiffs argue that the evidence is irrelevant for the first purpose because the tortfeasor takes his victim as he finds her.
