Order to Show Cause re: Appointment of Receiver
Tentative Ruling: The Court would like to hear from the parties regarding an appointment of an independent third-party auctioneer.
It appears that having an independent third-party auctioneer market and sell the Edna Street Property would be a less costly option. Thus, if the parties can agree on such an appointment, they should enter into a stipulation accordingly.
However, if the parties cannot come to such an agreement, it appears a Receiver should be appointed in this action. The Court will require the parties to agree on a Receiver to be appointed within ten (10) days; and if the parties are unable to agree, each party shall submit one name as a proposed Receiver within fifteen (15) days.
