Biography

The Hon. Paul D. Herbert is a judge for the Alameda County Superior Court in California. He was appointed to the bench in 2013 by former governor Jerry Brown. He filled the vacancy created by the retirement of the Hon. Robert K. Kurtz (Ret.).

He is a registered Democrat.

Judge Herbert received his B.A. from the University of California, Berkeley in 1977. He went on to earn his J.D. from the University of California, Hastings College of the Law in 1982. After graduating from UC Berkeley, Herbert worked as a ward clerk at the University of California Medical Center in San Francisco. He and others that held that position petitioned hospital management for a wage increase. The process involved research and negotiations, both of which Herbert found that he enjoyed. Not only did they successfully negotiate a pay increase, but the experience would serve as the catalyst for Herbert to pursue a legal career.

After law school, Herbert began working as a staff attorney for the Hon. Justice Allison Rouse with the California Court of Appeal for the First District, a position he would hold for one year. He then went to work for the Hon. Presiding Justice George A. Brown (deceased) and the Hon. Associate Justice Wickson Woolpert (deceased) with the Fifth District Court of Appeal in 1983, where he held the same position.

Three years later, Herbert entered into private practice, joining Ropers, Majeski, Kohn, and Bentley PC, where he would serve as an associate until 1990. It was at that time, that Herbert was named a partner for the firm, a position he would maintain for ten years. During his time there, Herbert worked on plaintiff-side class actions as well as civil defense.

Herbert left the firm in 2001 for another stint with the Court of Appeal, this time as a senior appellate attorney for the Hon. Justice Mark B. Simons with the First District. He would remain there until 2005.

He returned to private practice at that time, joining The Louderback Law Firm as a partner, until the firm merged with Payne and Fears LLP in 2006, where he then served as a principal at the firm. He remained with Payne and Fears until 2011 where he was serving as of counsel. Prior to his appointment to the Superior Court, he was partnering at Frassetto Herbert LLP.
