“A motion in limine is a motion preliminary to trial, and advisory until finally determined at trial, to preclude the introduction of prejudicial matters to the jury.” (See Christian v. Gray (2003) 65 P.3d 591, 610 n.22.)
“A motion in limine is a motion preliminary to trial to prevent introduction of prejudicial matters, and an order ruling on such motion is advisory until finally determined at trial.” (See Twyman v. GHK Corp. (2004) 93 P.3d 51, 61.)
“A pretrial motion in limine excluding evidence does not conclusively decide an issue of admissibility because the issue must be raised during a subsequent trial.” (See Andrew v. Elisa DePani-Sparkes, D.O. (2017) 396 P.3d 210, 224 n.55.)
“The ruling on a motion in limine is advisory only, and an incorrect ruling is not reversible error. In fact, no error occurs until the matter arises during trial, an objection is entered, and, at that time, the trial court incorrectly permits or prohibits it.” (See Davis v. State (1983) 665 P.2d 1186, 1197.)
“Trial court decisions concerning admission of evidence are reviewed on appeal pursuant to an abuse of discretion standard.” (See Chesapeake Operating Inc. v. Kast Trust Farms (2013) 352 P.3d 1231, 1236.)
“An abuse of discretion has been defined as a clearly erroneous conclusion and judgment, one that is clearly against the logic and effect of the facts presented.” (See Marshall v. State (2010) 232 P.3d 467, 474.)
“The trial court's decision whether to admit or exclude evidence will not be reversed absent a finding of a clear abuse of discretion.” (See Material Serv. Corp. v. Rogers Cnty. Bd. of Comm'rs (2011) OK Civ. App. 17)
It is well settled that “this Court has held that a ruling on a motion in limine is merely advisory and not conclusive, and that to properly preserve objections to the introduction of evidence that is the subject of the motion in limine, a timely objection must be made when the evidence is sought to be introduced.” (See Luna v. State (1992) 829 P.2d 69, 71.)
It is also well settled that “in limine rulings are preliminary and advisory in nature until point in trial at which evidence would have been admitted but for the motion. Consequently, liminal rulings are not appealable.” (See Clark v. Turner (2004) 99 P.3d 736, 741.)
