It is the court’s duty to protect infants and other wards of the court. (White v. DaimlerChrysler Corp., 57 A.D.3d 531, 533 [2nd Dept. 2008].) Court approval of the compromise of an infant’s claim is required. (Civ. Prac. Law & Rules, § 1207; Vladimir v. Mount Vernon Hebrew Camps, Inc., 9 N.Y.2d 21, 23 [1961].)
Parties to an action may not stipulate to voluntarily discontinue an action without judicial permission where any party is an infant, or if a person not a party has an interest in the subject matter of the action. (Civ. Prac Law & Rules, § 3217(a)(2).)
The procedures for settling a case on behalf of an infant are set forth in Section 1208 of Civil Practice Law and Rules. (Civ. Prac. Law & Rules, § 1208.) This statute requires the infant’s representative and attorney to make representations to the court concerning, inter alia, the terms of the settlement, the circumstances giving rise to the action or claim, the extent of the damages sustained by the infant as documented in medical or hospital records, and reasons for recommending the settlement. (Id.)
“[A] guardian ad litem is not authorized to apply to the court for approval of a proposed settlement of a party’s claim or to receive the proceeds of a settlement.” (Tudorov v. Collazo, 215 A.D.2d 750, 750-51 [2nd Dept. 1995].)
A minor’s settlement that is judicially-approved has the effect of a judgment. (Fletch v. Hatch, 197 A.D.2d 775, 776 [3rd Dept. 1993].)
The court may only grant leave to settle a minor’s claim where the proposed settlement is “fair and reasonable and in the infant’s best interests.” (Unger v. Coyle, 144 A.D.3d 668, 669-70 [2nd Dept. 2016].) The power of a court to approve a settlement does not mean that the court has the power to dictate the terms of a settlement. (Reed v. Tompkins Terrace, Inc., 209 A.D.2d 595 [App. Div. 2nd Dept. 1994].)
