Judge Peter H. Moulton - Professional Background & Legal Expertise

Biography

Hon. Peter H. Moulton is an associate justice of the Supreme Court of the State of New York, Appellate Division, First Judicial Department. He was appointed to the Appellate Division by Governor Andrew Cuomo in 2017.

At the time of his appointment, Moulton was serving as a justice of the New York County Supreme Court. He was elected to the seat in 2014. As such, he served concurrently as supervising judge of the New York City Asbestos Litigation and as the administrative judge of Civil Matters in the First Judicial District (2015 to 2017). Moulton also served as supervising judge of the Civil Court in New York County and as an acting justice of the New York County Supreme Court from 2010 to 2014. He began his judicial career in the Civil Court in 2004.

During his tenure as administrative judge, he introduced the Judicial Mediation Part (Part J-Med), which was created to encourage judicial participation in the settlement of post-note cases. He is also credited with helping to streamline the Commercial Division by diverting some commercial cases to the courts ADR Program. In 2013, Moulton helped organize a three-part program, “Transgender Litigants in the Court System: Providing Equal Access and Impartial Justice”, in partnership with the Judicial Institute.

Moulton received a B.A. in international relations from Stanford University in 1983. He went on to earn a J.D. from Columbia Law School in 1986. In law school, he served as managing editor of the Columbia Human Rights Law Review.

Prior to joining the judiciary, he was a principal law clerk to the Hon. Leland DeGrasse, justice of the New York County Supreme Court. Moulton entered into his clerkship in 1995. He also began his legal career as a law clerk to the Hon. Charles E. Stewart, a federal judge of the U.S. District Court for the Southern District of New York (1986 to 1988). After his first clerkship, Moulton became a staff attorney in the Affirmative Litigation Division of the New York City Law Department. In that position, he represented the City of New York in civil rights, commercial, and intergovernmental lawsuits. He remained in that capacity for seven years.

His committee memberships have included the Committee to Encourage Judicial Service (chair), the Civil Rights Committee, the Ad Hoc Subcommittee to Review the Nomination of Judge Steven Breyer to the U.S. Supreme Court, and the Administrative Law Committee of the Association of the Bar of the City of New York.
