Under Rule 1.140, Florida Rules of Civil Procedure, Verrillo's response to the Counterclaim was due on or by January 4,2022. On January 3,2022, the undersigned agreed to an extension of time until January 24, 2022 for Verrillo to respond to the Counterclaim. On January 24,2022, the undersignedagreed to a further extension until January 28,2022. That same day, on January 24, 2022, Verrillo filed a Motion for Enlargement of Time to Respond to Affirmative Defenses and Counterclaim, askingfor an indeterminate amount oftime to respond to same. Verrillo's counsel has yet to schedule said motion for hearing. Accordingly, as of today, Verrillo has failed to file an answer or motion directed at the Counterclaim, thus failing to properlyplead or defend. As such, a judicialdefault should enter againstVerrillo.
