Honorable: Thomas S. Clark Clerk: Linda K. Hall
Court Reporter: . None Bailiff: Deputy Sheriff
Interpreter: Language Of:
Court Call
NATURE OF PROCEEDINGS: MOTION TO COMPEL
Hearing Start Time:8:53 AM
The above entitled cause came on regularly on this date and time with parties and/or counsel appearing as
reflected.
Counsel Anna Galaviz appeared via court call on behalf of Plaintiff(s).
Counsel Douglas Proudfoot appeared via court call on behalf of Defendant.
Matter argued by counsel and submitted.
The Court makes the following findings and orders:
Plaintiff's Motion to Compel Deposition of Ford Motor Company's Person Most Knowledgeable with production of
Documents - Denied Without Prejudice.
Plaintiffs' motion to compel the deposition of Ford Motor Company's PMK is denied for failure to sufficiently meet
and confer, without prejudice to Plaintiffs being allowed to issue a new PMK deposition notice and to engage in
further meet and confer efforts.
A review of the papers before the court reveals that Ford objected to the deposition notice on numerous grounds,
including "location" and the fact that Ford is not a "resident" of California. These objections were not addressed in
Plaintiff's meet and confer and were not addressed in the moving papers.
Ford Motor Company is a party to this action. A review of the California Secretary of State's website, reveals that
Ford Motor Company is a Delaware Company with its place of business in Dearborn, Michigan. Plaintiff has
presented no evidence that Ford has designated a principal executive office in California or that it is a California
resident.

Plaintiffs here noticed the deposition to take place at 11845 W. Olympic Blvd., Ste. 1270, Los Angeles, CA 90064,
without providing any evidence that a Ford Motor Company business or executive office is within 75 miles. And
since this action is pending in Kern County, the deposition was also not noticed within the County where the action
is pending.
The parties should further meet and confer before Plaintiffs' counsel issues a new PMK deposition notice.
Clerk's minutes will be the order of the court.
Further notice waived.
