- Tentative ruling modified and becomes order:; MOTION TO AMEND JUDGMENT BY PLAINTIFF
The Motion of Plaintiff and Judgment Creditor Hoa Phan ("Plaintiff") to Amend Judgment is
**CONTINUED to December 18, 2020, at 1:30 p.m.** in the Law & Motion department in order to allow
Plaintiff to provide additional information to the Court, as set forth below.
The only evidence Plaintiff has provided that would support amending the Judgment is a Fictitious
Business Name Statement (the "Statement") showing that "City Cafe of Colma" is a fictitious business
name. (See Lagos Decl., Exh. 13.) However, Plaintiff has not provided sufficient information that would
enable to Court to take judicial notice of the Statement. (Evid. Code 453.) The Statement is not
certified, and the declaration of Plaintiff's counsel provides no explanation as to how the Statement was
obtained. Thus, Plaintiff shall file and serve a supplemental declaration with additional information
regarding the Statement by December 18, 2020.
If Plaintiff provides sufficient information to enable the Court to take judicial notice of the Statement,
the Court will consider amending the judgment.
