The Court makes the following findings and orders: (1) Motion to compel responses and production to Request for Production, Set Four: Defendant County of Kern's motion to compel further responses and document production from Plaintiff LPOD with respect to Request for Production, Set Four, nos. 23 and 24 is granted, except that all privileges (including tax return privilege and trade secret privilege ) are preserved and Plaintiff need not disclose any expert discovery at this time. Plaintiff shall serve further verified responses along with production of responsive documents by 01/15/2021. (2) Motion to compel document production arising from deposition of LPOD employee April Tooker on June 22, 2020 MINUTES Page 1 of 2 LPOD, INC., A CALIFORNIA CORPORATION, DBA LAS PALMAS OIL & BCV-18-102825 DEHYDRATION VS COUNTY OF KERN ET AL Defendant County of Kern's motion to compel document production arising from a subpoena for the deposition of LPOD's bookkeeper April Tooker is denied without prejudice. Furthermore, the motion was not served on the deponent, April Tooker, who had been subpoenaed and from whom the documents were sought as required by CCP section 2025.480(c). The motion to compel production of documents in the April Tooker subpoena is denied without prejudice to any party being allowed to conduct additional discovery as they deem necessary and appropriate. (3) Defendants County of Kern, Kern County Public Health Services Department and Kern County Environmental Health Services's motion to consolidate for purposes of discovery: Granted in part / Denied in part. Denied as to Schnitzer V. LPOD and Kinder V. Morgan without prejudice. Court to RE-ASSIGN BCV-19-102513-DRL which is a Judge Lampe case. This said case is NOT consolidated with BCV-18-102825-TSC it will remain related but will be re-assigned to Judge Thomas S. Clark for all purposes.
