Upon the Affidavit of Nina Zhang, dated September 30, 2020, and exhibits annexed thereto,
the Affirmation of Yimin Chen, dated October 1, 2020, and exhibits annexed thereto, Plaintiff’s
Memorandum of Law in Support of the Application for Temporary Restraining Order and Other
Relief, and all other papers and proceedings heretofore had in this action, and upon the applicable
law, it is hereby:
ORDERED that Defendants show cause before this Court, at Part __ of the Supreme Court
of the State of New York, County of Kings, at the Courthouse thereof, Supreme Court Building,
360 Adams Street, Brooklyn, New York, on the _____ day of October 2020, at _________ on that
day, or as soon thereafter as counsel can be heard, why an Order should not be issued in this action
granting preliminary and permanent injunctions pursuant to CPLR 6301 prohibiting the sale,
transfer, removal out of the State of New York, or other disposition of the vehicle at issue in this
case (the “Subject Vehicle”) and it is further
ORDERED that pending a decision on the aforesaid motion for a preliminary injunction,
pursuant to CPLR 6313 and CPLR 7109(a), Defendant and all those acting in concert or
cooperation with Defendant, are temporarily restrained from directly or indirectly selling,
transferring, assigning, encumbering, moving out of the State of New York, or otherwise disposing
of the Subject Vehicle pending further Order of this Court; and it is further
ORDERED that service of a copy of this Order to Show Cause, together with the papers
upon which it is based, shall be served by hand or by First Class Mail, postage prepaid at the
addresses below on or before October ________, 2020, shall be deemed good and sufficient
service; and it is further
ORDERED that opposition papers, if any, are to be served via overnight delivery upon
counsel for Plaintiff, Law Offices of Chen & Associates, P.C., 3915 Main Street, Suite 502,
Flushing, NY 11354, Attention: Yimin Chen, Esq., on or before October ____, 2020, and that any
reply by Plaintiff shall be served by First Class Mail on or before October ____, 2020.
