Therefore, much of plaintiffs’ motion arguing the necessity of a case management order is not disputed and will not be addressed here. However, AMERICAN WOODMARK opposes this case management order. For more than a year, the parties have been exchanging proposed elements for a case management order. The reason that this motion is now required, is that there has been no consensus. On several occasions AMERICAN WOODMARK has corresponded with the attorney for 10 plaintiffs regarding some very simple, basic and non-intrusive 11 interrogatories. Plaintiffs' attorney has agreed to include these 12 interrogatories on several occasions. Perhaps inadvertently, these 13 questions were left out of the current case management order at issue 14 here. 15 AMERICAN WOODMARK requests that the following interrogatories be 16 included in this case management order, and that the plaintiffs respond 17 within 30 days of entry of the case management order: 18 SPECIAL INTERROGATORIES TO PLAINTIFFS 19 SPECIAL INTERROGATORY NO. 1: 20 Do YOU (responding party or your respective client and include each 21 person and/or entity acting on its behalf, including, but not limited 22 to, all directors, officers, and agents of the responding party) have 23 an ownership interest in any real property? If so, state: 24 (a) The description of the real property owned; 25 (b) The date YOU receive title to the real property; 26 (c) The name of the person/entity who transferred the real 27 property to YOU; 28 ///// -2- AMERICAN WOODMARK’S OPPOSITION TO PLAINTIFFS’ MOTION TO ENTER A CASE MANAGEMENT ORDER SPECIAL INTERROGATORY NO. 2: Do YOU have an ownership interest in any improvements (i.e., buildings, pools, etc.) on the subject property? If so, state: (a) The description of the improvements; (b) The date YOU received ownership interest in the improvements; (c) The name of the person/entity who transferred the improvements to YOU; (d) If built by YOU the date of completion and the name of the 10 person or entity who built each improvement. 11 CONCLUSION 12 These interrogatories are essential for analyzing liability as it 13 relates to the Right to Repair Act (Civil Code §895, et sec.).
