Agency, Central Coast Water Authority, Dudley Ridge Water District, County of Kings, Oak Flat
Water District, Palmdale Water District, Santa Clarita Valley Water Agency, San Gabriel Valley
Municipal Water District, and Tulare Lake Basin Water Storage District (collectively “Petitioners
and Plaintiffs”) file this Supplemental Case Management Conference Statement to respond to
Respondents’ and Defendants’ State of Califomia Department of Fish and Wildlife (“DFW”) and
State of Califomia Department of Water Resources (“DWR’”) (and collectively, “Respondents”)
Joint Case Management Statement filed on September4, 2020 because Respondents’ requests for
a.case management order and continuance were not raised during any meet-and-confer with

16 pp. 6-9.) Petitioners and Plaintiffs do not object to a continuance of the CMC. Petitioners and
17 Plaintiffs respectfully request, however, that the Court deny Respondents’ request fora
18 scheduling order. If the Court is considering granting Respondent’ s request for a scheduling
19 order, Petitioners and Plaintiffs request an opportunity to brief the issue and be heard, or at the
20 very least an opportunity to address it at the CMC hearing.
21 Plaintiffs have not agreed that the deadline to file a first responsive
pleacing should be
22 extended. Respondents’ assertion that Code Civ. Proc. section 1089.5 arguably applies to non-
23 mandamus causes of action is unsupported by the plain text of that provision or any case law.

1 Section 1089.5 provides in full: “Where a petition for writ of mandate is filed in the tial court
25 pursuant to Section 1088.5, and where a record of the proceedings to be reviewed has been filed
26 with the petition or where no record of a proceeding is required, the respondent shall answer or
otherwise respond within 30 days after service of the petition. However, where a record of the
27 proceeding to be reviewed has been requested pursuant to Section 11523 of the Govemment
Code, or otherwise, and has not been filed with the petition, the party upon whom the petition has
28 been served, including any real partyin interest, shall answer or otherwise respond within 30 days

DWR offers no evidence that extending Respondents’ deadline to respond to the contract
claims will serve judicial economy or avoid the potential for multiple inconsistent rulings, which
would be the only legitimate reasons to extend it. Instead, Respondents inconsistently assert that
“Respondents do not believe it is efficient for any of the various Superior Courts to enter case
Management orders[,]” only to ask for exactly that in the next sentence: “Respondents request
that, with the exception of entering a scheduling order as to the timing of the responsive pleading
presented below, the Court continue the CMC for 60 days.” (Respondents’ Joint Case
Management Statement at p. 6:6-9.)
There is no risk of multiple inconsistent rulings with respect to the non-mandamus causes
at 10 of action in the three cases where such claims have been asserted because those three cases are

16 deadline indefinitely, it will prejudice Plaintiffs by delaying prosecution of their contractual
