Plaintiff JAMES IRRIGATION DISTRICT [“JID”) filed a verified complaint against Defendants KINGS RIVER WATER ASSOCIATION [“KRWA”), STEVE HAUGEN, and twenty three other member units of KRWA on March 1, 2019. \OOOVOUWAOJMI—l Defendants answered on May 31, 2019. A fifteen day jury trial is scheduled to commence December 7, 2020. B. On September 23, 2020, JID applied, ex parte, for an order shortening time to file a motion to amend complaint and motion t0 bifurcate. The application was granted, and the Court set the hearing 0n the motions, along with a Status Conference, for October 21, 2020. C. JID timely filed and served its motion to amend complaint and motion to bifurcate on September 25, 2020. Attorneys for the parties, after having met and conferred, agree that JID’S pending motions are best resolved by stipulation at this time, viz. JID may amend its complaint, subject t0 certain conditions, and that the issue of bifurcation is more suitable for consideration closer to trial. By this stipulation, the hearing on JID’s motion to amend complaint and motion to bifurcate shall be vacated, as unnecessary. D. The Parties agree that pursuant to California Rules of Court Rule 3.1332(c), good cause exists to continue the trial because 0f: (1) JID’s amended complaint; (2), the number of Defendants in this case; and (3) the ongoing COVID- 19 pandemic.
