WHEREAS Petitioner Direct Access Partners, LLC (“DAP”) and Respondent Brian I.
Pfeffer (“Pfeffer”) have reached an agreement in principle to settle the above-captioned matter,
including the underlying arbitration claims;
WHEREAS this agreement in principle to settle is only with respect to Respondent
Pfeffer and does not include any other respondent in this action;
WHEREAS Petitioner DAP and Respondent Pfeffer are currently developing a written
agreement to memorialize the settlement in the above-captioned matter;
WHEREAS Petitioner DAP and Respondent Pfeffer anticipate resolving this matter in
its entirety in the near-term;
IT IS HEREBY STIPULATED AND AGREED by and between the attomeys for
Petitioner DAP and Respondent Pfeffer, that the hearing pursuant to the March 26, 2014 Order to
Show Cause For Temporary Relief and Proposed Order of Attachment in Aid of Arbitration,
presently scheduled for Thursday April 24, 2014, as between Petitioner DAP and RespondentPfeffer and only with respect to Respondent Pfeffer, is hereby postponed to Friday, May 2, 2014,
or to a date convenient for the court.
