Plaintiff's motion in limine to preclude the testimony of the medical expert, Neal
Hochwald, MD is baseless, unwarranted and completely disingenuous.
At the outset it should be underscored that theclaimed injuries and treatmeñt received by the plaintiff
isminimal. Therefore, for plaintiffto suggest the expert disclosure needs to be more detailed isnot just not
possible based on the facts of the case. The plaintiff sought medical attention for the injuries she is claiming
approximately eleven times over the course of almost five years. The plaintiffonly treated with an urgent
"injuries"
care center and orthopedist Dr. McIntrye, her intended expert, in connection to the underlying this
case. She received a couple of injections and underwent a relatively minor trigger thumb surgery.

Furthermore, to suggest the expert should be precluded because the disclosure does not
specifically state which medicals he reviewed is ludicrous in thiscase as there are no more than 5 relevant
records in thiscase. This information could also certainly be ascertained on cross examination. Interestingly,
plaintiff claims we should have listed all peer reviewed medical literature and/or treatises used by Dr.
Hochwald yet plaintiff's own expert disclosure and accompanying report are completely silenton this issue.
Plaintiff'scounsel cites to a thirddepartment case Brossoit v. Obrien to support his claim that the
defendants' "deficient."
expert disclosure is Brossoit is distinguishable from the present facts. InBrossit the
Court ruled that plaintiff's expert economist was required to compute the plaintiff's losses and the manner
in which the losses were converted to present value. The information the court ordered the plaintiff to
supplemêñt was pretty basic and central to the expert economist's opinion. Here, the defendants have
provided a summary of Dr. Hochwald's anticipated testimony which iscompliant with CPLR 3101(d)(1)(I)

and discussed more fully below. Annexed hereto as Exhibit isthe expert disclosure.
Incredulously, the plaintiff makes the argument that the defendants were required to mention the
plaintiff's predisposition of trigger finger or the fact that the bite did not cause the injury in a Bill of
Particulars. Unsurprisingly, plaintiff cites to no legal authority in support of this claim. There is no
requirement that an expert disclosure must be identical to a Bill of Particulars. Clearly developments in
discovery, receipt of medicals and party deposition testimony evolve during the course of litigationwhich

often changes the nature and character of an expected expert's testimony.

Plaintiff argues that the expert disclosure failed to explain the basis of Dr. Hochwald's
opinion in scientific or factual terms. CPLR 3101(d)(1)(I) states the following:
Experts. (i)Upon request, each party shall identify each person whom the
party expects to call as an expert witness at trial and shall disclose in
reasonable detail the subject matter on which each expert is expected to
testify,the substance of the facts and opinions on which each expert is
expected to testify,the qualifications ofeach expert witness and a summary
of the grounds for each expert's opinion.
Here, the defendants complied with the statute.The expert disclosure of Dr. Hochwald sets forththat
Dr. Hochwald isbasing his opinion on the medical records, deposition testimonies of the parties as well as
the pleadings. The expert disclosure goes on to state that Dr. Hochwald does not believe the dog bite caused
the plaintiff's claimed injuries specifically right trigger thumb and DeQuravain's Tenosynovitis. It is
anticipated that Dr. Hochwald will discuss the causes and risk factors of the conditions plaintiff is
complaining of. In furtherance of this conclusion he believes the plaintiff was at risk for developing the
conditions plaintiffclaims were the result of the dog bite.Importantly the expert disclosure explicitly states
Dr. Hochwald will rebut plaintiff's claims. The opinions were formulated based on the facts ascertained by
the through the documents he reviewed.

McIntrye's opinion is based on the expert disclosure and his written report is thatthe injury sustained to
plaintiff's right thumb was the cause of her right DeQuarvain's tenosynovitis and the righttrigger thumb.

disingenuous because the expert disclosure does not explain the theories he relied upon to formulate his
opinion which counsel claims we should have supplied in our expert disclosure.

The defendants take strong exception to plaintiff's characterization that the expert disclosure of Dr.
Hochwald isuntimely. CPLR 3 101(d) does not establish a specific time frame for expert witness disclosure,
a trial
court has discretion to preclude expert testimony for the failure to reasonably comply with the statute.
Lucian v. Schwartz, 55 A.D.3d 687, 865 N.Y.S.2d 643(2d Dep't 2008), see, Martin v. NYRAC, Inc., 258
A.D.2d 443, 684 N.Y.S.2d 605 (1999). It iswell settled that a determination as to whether to preclude a
party from introducing the testimony of an expert witness at trialbased on CPLR 3 I01(d)(1) is leftto the
sound discretion ofthe court. Rivera v. Monteflore Med Ctr.,28 N.Y.3d 999 (2016).The Second Department
affirmed the trialcourt's decision inprecluding expert testimony elicited on the second day oftrial.Deandino
v. New York City Tr. Auth., 105 A.D.3d 801, 963 N.Y.S.2d 288 (2d Dep't 2013). Itshould be noted that the
Court in Deandino cited to the Rivers case, specifically stating CPLR 3 101 d (1) does not automatically
preclude experts, disclosed near commencement of trialfrom testifying at trial.

The defendants served the expert disclosure of Neal Hochwald, MD on July 8, 2019, aftergood faith
settlement negotiations failed and more than a month prior to the commencement selection.As noted I

above, the Courts in this state have not promulgated a certain time frame for expert disclosure but have
precluded an expert where a party has served the an expert testimony elicited on the second day of trial.In
this case the defendants served their expert disclosure 36 days in advance of trialwhich issimply not the
