STIPULATION AND ORDER RE: CONSOLIDATION

WHEREAS, the Plaintiffs in the 28 cases listed in the Addendum attached herewith
("Plaintiffs") have filed individual actions against Defendant BRIDGE Property Management
‘“iSBMC") alleging that BPMC willfully violated mandatory requirements of the
compliant applications, failing to inform Plaintiffs of investigations to be conducted about them
and intentionally failing to furnish prospective tenants with copies of investigative reports about
them for leases at residential properties BPMC manages;
WHEREAS, each case also asserts claims of unfair business practices under California's
Unfair Competition Law based on the same underlying conduct;
WHEREAS, six of the 28 cases, involving a total of seven plaintiffs, make additional
allegations that BPMC improperly entered their homes and assert causes of action for invasion of
privacy and intentional infliction of emotional distress: The cases asserting tort causes of action
are Valencia (CGC-19-578411), Morales (cGc- 19-578649), Hernandez (CGC-19-578460),
Santana (CGC-19-578413), Valenzuela (CGC- 19-578459), and Bernuy (CGC- -19-579278) ("the
Tort Actions");
WHEREAS, on October 4, 2019, Defendant filed a motion to consolidate the cases and
the motion has been fully briefed;
WHEREAS, all of the cases listed in the Addendum were subsequently designated
complex by the Court and singly assigned to the Complex Litigation Department in Department
304;
WHEREAS, pursuant to the Court's order, the parties provided an updated summary of
their positions on consolidation in a joint statement filed on January 30, 2020, and the parties are
in agreement on the manner in which the cases should be consolidated and therefore stipulate to
consolidation as set forth in this stipulation;
WHEREAS, Code of Civil Procedure section 1048 authorizes the court to issue orders
consolidating the cases as well as order "Joint hearing or trial of any or all the matters in issue in

144\29412765 144.2the actions." (Subd. (a).) Code of Civil Procedure section 1048(b) permits the court to "order a
separate trial of any cause-of action ... or of any separate issue or of any number of causes of
action or issues, preserving the right of trial by jury required by the Constitution or a statute of
this state or of the United States;”
THEREFORE, all Plaintiffs in the 28 cases listed on the Addendum and BPMC, through
their respective counsel, hereby STIPULATE AND AGREE AS FOLLOWS:
1, All of the ICRAA and UCL causes of action involve sufficiently common facts such
that joining all 28 cases together for pre-trial and trial purposes is appropriate. A joint
trial of the cases on the ICRAA and UCL causes of action would be a fair and efficient
way to resolve the disputes. This is permitted under Code of Civil Procedure section
1048(a).
2. The Tort Actions implicate individualized facts and the factual differences between
each of the plaintiffs' invasion of privacy and IIED claims predominate the similarities.
These Tort Actions should still be consolidated with the remainder of the 28 cases for
pre-trial purposes to minimize duplication and allow for the coordinated scheduling of
any depositions. However, the Tort Actions should not be tried jointly. Rather,
separate trials for each of the Tort Actions is appropriate to resolve their other causes
of action.
3. A separate judgment should be entered for each matter.
4. Thus, the parties HEREBY STIPULATE to consolidation of all of the cases listed in
_ .the Addendum for pre-trial purposes, a joint trial of all of the cases. on the ICRAA-and
UCL claims, and the holding of individual trials for the Tort Actions to resolve the
causes of action alleged therein.

AS FOLLOWS:
1. All 28 cases listed in the Addendum are consolidated for all pre-trial purposes.

4, A separate judgment shall issue for each of the cases listed in the Addendum.
5. The lead case in the matter shall be Arnetha Dennis, et al. v. BRIDGE Property
Management Company, San Francisco Superior Court case number CGC-19-574516. A copy
of this Order shall be filed in each of the actions listed in the Addendum, but all other pleadings
shall be filed only in case number CGC-19-574516, and shall be entitled "ARNETHA
DENNIS, ASIA DENNIS and ROBYN DENNIS, Plaintiffs v. BRIDGE PROPERTY
MANAGEMENT COMPANY, ‘and DOES 1 through 10, Defendants; and Related Actions."
IT IS SO ORDERED.
