WHEREAS, on March 3, 3022, the Court issued an Order (NYSCEF No. 32) in the above-
referenced action that provided, among other things, that the deposition of Marriott would take
place by March 28, 2022 (or on another mutually convenient date shortly thereafter).
WHEREAS, the parties have conferred and the earliest date that Marriott, Plaintiff and
Defendant are available for deposition is May 9, 2022.
WHEREAS, the parties have agreed that an extension of the deadlines is necessary to
accommodate the Marriott deposition.
NOW, THEREFORE, IT IS HEREBY STIPULATED AND AGREED by and between
the parties that the following schedule shall apply to this matter:
1. Affirmative expert reports for both parties shall be served by June 16, 2022, rebuttal
reports for both parties shall be served by July 15, 2022, and the deadline for expert depositions is
August 31, 2022.
2. The note of issue deadline is extended to September 15, 2022.
3. The July 15, 2022 status conference is adjourned and will be rescheduled at a date
agreeable to the Court.
