Plaintiff Walter L. Stipa Sprecase or "Plaintiff"), having moved this Court for an
Order for Sanctions for Fraud upon the Court and Frivolous Conduct, pursuant to 22 NYCRR §
("Tenreiro"
130-1.1 and CPLR § 3126, against Defendant Daniel Tenreiro or "Defendant"), upon
Order to Show Cause, filed on October 19, 2019 [NYSCEF Doc. Nos. 84-100], signed on October
24, 2019 [NYSCEF Doc. Nos. 101], Defendant having opposed this Motion on November 27, 2019
[NYSCEF Doc. Nos. 105-1 15], and Plaintiff's Motion for Sanctions granted in favor of Plaintiff and
against Defendant by Decision and Order of The Honorable Andrew Borrok, dated January 17, 2020
[NYSCEF Doc. No. I 18](the "January 17, 2020 Order"), awarding judgment in favor of Plaintiff
Stipa and against Defendant Tenreiro, in an amount to be determined at hearing to be conducted by
the Special Referee Part, the parties having appeared before Special Referee Helen Z. Galette on
November 22, 2021, December 6, 2021, and March 7, 2022 for evidentiary hearing on the issue of
attorney's fees to be awarded as sanctions against Defendant (the "Hearing"), and Special Referee
Helen Z. Galette having issued a Decision and Order/Hear and Determine (the "Decision and Order")
on April 15, 2022, which states in relevant part that:
"[1]t is hereby ORDERED AND ADJUDGED that Plaintiff [Stipa] is entitled to recoup
$66,883.50 from the Defendant Daniel Tenreiro as and for Plaintiff's legal fees; and it isfurther

ORDERED AND ADJUDGED that Plaintiff [Stipa] isentitled to recoup $3,385.76 plus the
cost of the trialtranscript as and for Plaintiff's disbursements; and itis further
ORDERED AND ADJUDGED that the Clerk of the Court is directed to enter judgment in
favor of Plaintiff Walter L. Stipa as against Daniel Tenreiro in thetotal amount of $70,269.26 plus
the cost of 100% of the trialtranscript"; and
Special Referee Helen Z. Galette's Decision and Order having been duly entered by the Clerk
of the Court on May 1 1, 2022 [NYSCEF Doc. No. 330], and Plaintiff having duly served a copy of
the Decision and Order with Notice of Entry on May 1 1, 2022 [NYSCEF Doc. Nos. 331 and 332];
IT IS HEREBY ADJUDGED that PlaintiffWalter L. Stipa recover from and have judgment
against Defendant Daniel Tenreiro, who resides at 470 Park Avenue, Apt. 8D, New York, New York
10022, in the sum of $66,883.50 (Sixty-Six Thousand Eight Hundred Eighty-Three Dollars Fifty
Cents), plus disbursements in the amount of $3.385.76 (Three Thousand Three Hundred Eighty-Five
Dollars Seventy-Six Cents ),plus 100% of transcript costs forthe Hearing, in the sum of $2,922.70
(Two Thousand Nine Hundred Twenty-Two Dollars Seventy Cents), for a total sum of $73,191.96
(Seventy-Three Thousand One Hundred Ninety-One Dollars Ninety-Six Cents), and thereafter post-
judgment interest at the highest applicable statutory rate;and thatthe PlaintifThave execution thereof.
