The above-referenced matter is scheduled on the Chambers Calendar for 8/11/21 with regard to the Petition to Seal Records. Pursuant to the Administrative Orders of the Court as well as EDCR 2.23, this matter may be decided with or without oral argument. This Court has determined that it would be appropriate to decide this matter on the pleadings, and consequently, this minute order issues. NRS 179.2405 indicates that the ". . . public policy of this State is to favor the giving of second chances to offenders who are rehabilitated . . ." The Petition does not include an Affidavit of the Petitioner, or any other information which indicates that the Petitioner has been rehabilitated. The Court acknowledges that if this Petition is denied under NRS 179.245, it may not be brought back for a rehearing any sooner than 2 years after the denial, and consequently, instead of denying the Petition outright, the Court will continue the hearing on this Petition for an additional 30 days, to allow the Petitioner to submit the additional information, and to comply with the statutes. Consequently, and good cause appearing, IT IS HEREBY ORDERED that the Petition to Seal Records is hereby CONTINUED to 9/8/21 at 9:00 AM.
