Reply has not been filed to date. Opposition was served by overnight mail on defendants on June 28, 2018. Based on the pleadings on file, the motion to quash service of summons and complaint is denied. Each individual defendant did not file his own declaration. The joint declaration was without foundation as to the claim that “The summons filed by Plaintiff shows that I was NOT personally served.” The verified proofs of service filed by plaintiff show proper service on defendant Erick Alvarez by personal service and proper substitute service on Mario Burnias. The court finds that the declarations of defendants are not credible. (Evangelize China Fellowship Inc v Evangelize China Fellowship, Hong King  (1983) 146 Cal.App.3d 440, 449 [trial court may determine a conflict of the evidence on jurisdictional facts].)
The other requests made in the motion (to remove the lis pendens and to have the matter resolved under an internal dispute resolution in the partner’s agreement) are not matters
