Eugene Fernandez is denied as moot.
The Defendants cross-move to quash the Notice to Take Deposition of Non-Party
Witness and Deposition Subpoena Duces Tecum which was served upon Mr. Eugene
Fernandez. The record reveals that this cross motion was served on March 27, 2024, one
month after the Plaintiff demanded that Mr. Fernandez provide documents and appear for
a deposition on February 21 and February 28, 2024, respectively.
Pursuant to CPLR 2304, "a motion to quash, conditions
fix or modify a subpoena

was brought after the return date of the Subpoena and is untimely. Moreover, there is no
reason to wait until the return date because this relief is no longer available.
