PETITION TO ESTABLISH PATERNITY CUSTODY
COMES NOW the Plaintiff, Daniel G. McCarthy, by and through his attomey
Kevin L. Hickey, and for his Petition to Establish Patemity and Custody states and
alleges as follows:
L The Plaintiff is a resident of Bentonville in Benton County, Arkansas.
Upon information and belief, the Defendant and minor children have recently relocated to
Hot Springs, Arkansas. This Court has jurisdiction over the parties, and subject matter
and venue are proper.
2. Plaintiff is the biological father of the minor children Cooper Chase
McCarthy (DOB: 2/9/2015) and Sullie Ryan McCarthy (DOB:712/2016).
3. Plaintiff and Defendant engaged in sexual relations during a time that
corresponds with the date of birth for each minor child, and Defendant openly
acknowledges that Plaintiffis the father of both children.
4. Plaintiff should be determined to be the biological father of the minor
child, and Plaintiff requests that the Court grant an order of patemity.
5. Plaintiff states that it is in the best interests of the children that Plaintiff
have primary custody; accordingly, he requests that the Court grant him primary custody
over both of the parties' minor children. Plaintiff further states that he has not seen his
children in approximately two months' time, and requests that the Court award him
visitation while this matter is pending. Plaintiff request the Court schedule a temporary
hearing to establish visitation rights at the earliest possible date.
6. Upon information and belief, Plaintiff alleges that Defendant has or
intends to relocate the minor children to Hot Springs. Arkansas. Such relocation is not in
the b€st interests ofthe minor children.
WHEREFORE. Plaintiff prays that this Court enter an order of patemity
establishing him as the minor children's father and granting him immediate visitation
rights; for primary custody of the minor children; for the relief described above; and for
any and all other reliefto which he may be entitled.

4. I was in a relationship with Daniel Giroux McCarthy and together we have two
minor children, Cooper Chase McCanhy, bom 0210912015 and Sullie Ryan McCadhy, bom
710212016, until the Temporary Order entered in this casc on October 6, 2017.
5. Daniel Giroux McCarthy and I have never been married and no court has
adjudicated Daniel Giroux McCarthy as the father of Cooper Chase McCarthy or Sullie Ryan
McCarthy.

6. I lived with Daniel Giroux McCarthy and our two minor children at 3006 SW
Oakleigh Road, Bentonville, Benton County, Arkansas fiom April 15,2017 . until I moved to Hot
Springs, Garland County, Arkansas, in July of20l7.
7. I separated from Daniel Giroux McCarthy on June 9.2017, after Daniel Giroux
Mccarthy was arrestcd and charged rvith Domestic Assault 2nd Degree. This charge is currently
pending in thc Bentonville County District Court, Bcntonville Division, Case No. CR 2017-635
8. After Daniel Giroux McCarthy was arrested, he was order to have no contact with
me. I had no job and no means of support. I rclocated to Hot Spnngs, Arkansas. so I could rely
on my family mernbers for support.
9. On July 3, 2017, I was issued a new Arkansas Driver's License with the address
of 528 Oaklau'n Blvd, Hot Springs, Arkansas 7l 9l 3.
10. My parents, Jeffiey Scott Ashburn and Lisa Ashbum. Ive at l0l Ridgewood
Street, Hot Springs, Garland County, Arkansas, and they have lived in Hot Springs, Arkansas, for
more than thirty (30) years.
I 1. By August of 2017 ,l had enrolled my minor children in WIC, enrolled my family
for SNAP benefits. and sigrred my minor children up for Medicaid coverage, all with the address
of 528 Oaklawn Blvd. Hot Springs, Garland County, Arkansas 71913.
12. Our minor children, Cooper Chase Mccarthy and Sullie Ryan McCarthy, were
evaluated by liccnsed professionals and. based upon these evaluations, they rvere erolled in the
First Step Arkansas facility in Hot Springs, Arkansas, to address certain issues with dclaycd
development. Both children began attcnding this facility on or about August 14,2017 .

I am the Defendant in a current, pending case in Benton County Circuit Couq styLed as Daniel G. McCarthy v. Amber D. Ashbunt. rvith a case uumber of04DR-2017-1263-3. 3. i currently rcside at 528 Oaklawn Blvd., Hot Springs, Garland County, Arkansas. I have livcd at this address since July of20l7. 4. I was in a relationship with Daniel Giroux McCarthy and together we have two minor children, Cooper Chase McCanhy, bom 0210912015 and Sullie Ryan McCadhy, bom 710212016, until the Temporary Order entered in this casc on October 6, 2017. 5. Daniel Giroux McCarthy and I have never been married and no court has adjudicated Daniel Giroux McCarthy as the father of Cooper Chase McCarthy or Sullie Ryan McCarthy. I lived with Daniel Giroux McCarthy and our two minor children at 3006 SW Oakleigh Road, Bentonville, Benton County, Arkansas fiom April 15,2017 . until I moved to Hot Springs, Garland County, Arkansas, in July of20l7. 7. I separated from Daniel Giroux McCarthy on June 9.2017, after Daniel Giroux Mccarthy was arrestcd and charged rvith Domestic Assault 2nd Degree. This charge is currently pending in thc Bentonville County District Court, Bcntonville Division, Case No. CR 2017-635 8. After Daniel Giroux McCarthy was arrested, he was order to have no contact with me. I had no job and no means of support. I rclocated to Hot Spnngs, Arkansas. so I could rely on my family mernbers for support. 9. On July 3, 2017, I was issued a new Arkansas Driver's License with the address of 528 Oaklau'n Blvd, Hot Springs, Arkansas 7l 9l 3. 10. My parents, Jeffiey Scott Ashburn and Lisa Ashbum. Ive at l0l Ridgewood Street, Hot Springs, Garland County, Arkansas, and they have lived in Hot Springs, Arkansas, for more than thirty (30) years. I 1. By August of 2017 ,l had enrolled my minor children in WIC, enrolled my family for SNAP benefits. and sigrred my minor children up for Medicaid coverage, all with the address of 528 Oaklawn Blvd. Hot Springs, Garland County, Arkansas 71913. 12. Our minor children, Cooper Chase Mccarthy and Sullie Ryan McCarthy, were evaluated by liccnsed professionals and. based upon these evaluations, they rvere erolled in the First Step Arkansas facility in Hot Springs, Arkansas, to address certain issues with dclaycd development.
