Angela Melchiorre et al Index No. 010233/2021 To all Counselors: I am writing to you with respect to the above-referenced matter, scheduled for in-person Trial before me on August 14, 2023 at 9:30 a.m. The parties and their attorneys will appear at 9:00 a.m. in order to pre-mark any Exhibits and the Trial will commence at 9:30 a.m. The Trial is a Jury Trial and is scheduled to run for no more than five (5) days. It is the understanding of the Court that all parties and witnesses, including experts, if any, will be available on this date. A final pre-trial conference is scheduled for August 1, 2023 at 10:30 a.m. Any failure to appear at the scheduled Pre-Trial Conference may be deemed a default by the Court pursuant to 22 NYCRR § 202.27. The failure of a plaintiff or plaintiff's attorney to appear may result in the dismissal of their action; the failure of a defendant or defendant’s attorney to appear may result in the granting of a judgment by default against that defendant; and the failure of all parties or their attorneys to appear may result in such other order as appears just. NO. 30 RECEIVED NYSCEF: 04/19/2023 Page 2 April 18, 2023 in any settlement, including those holding liens on any settlement or verdict, shall attend the Pre-trial Conference in person or shall be available by telephone at that time The trial having been scheduled at least two (2) months in advance, the provisions of 22 NYCRR § 125.01(g) apply to this matter: [t]he attorneys previously designated as trial counsel must appear for trial on that date. If any of such. attorneys is actually engaged on trial elsewhere, he or she must produce substitute trial counsel. If neither trial counsel nor substitute trial counsel is ready to try the case on the scheduled date, the court may impose any sanctions permitted by law. The current General Rules for Jury Trials in Onondaga County Supreme Court are attached, as well the Court’s Jury Selection Rules. The parties will comply with all deadlines set forth in the General Rules for Jury Trials in Onondaga County Supreme Court. Unless otherwise specified, the Court herby directs that Plaintiff's expert disclosure, if any, must be served on Defendants no later than May 15, 2023, and Defendants’ expert disclosure, if any, must be served on Plaintiff by June 15, 2023.
