Overview
This is a proceeding pursuant to CPLR Article 78 to annul a decision of the
Respondent, New York City Department of Housing Preservation and Development
(“HPD”), that threatens to force Petitioner, Lissette Jimenez, a disabled and indigent
woman on a fixed income, into homelessness.
Ms. Jimenez grew up with her grandmother in their Tenant Interim Lease Apartment
(TIL). In 2017, Ms. Jimenez’s grandmother fell ill and she moved back in to care for
her grandmother. On June 22, 2021, Ms. Jimenez’s grandmother passed away, only a
few months after Ms. Jimenez lost her mother. Ms. Jimenez began the difficult task of
submitting an application for succession to remain in her family home within 30 days
of her beloved Grandmother’s death.
